Case Studies

Gary Capata, Senior Partner, has testified in more than 150 cases. Although every matter is important, there are several that highlight the level of excellence that is the hallmark of our Orange County CPA firm.

  1. Palm Medical Group – In the often-cited opinion of the California Supreme Court Sargon Enterprises Inc. v. University of Southern California, 55 Cal. 4th 747 (2012), The Court of Appeal majority found that the case of Palm Medical Group, Inc. v. State Comp. Ins. Fund (2008) 161 Cal.App.4th 206 ― is an excellent example of the level of care an expert should exercise. In Palm Medical, a medical clinic sued, claiming it was wrongly denied admission into a preferred provider network. The Court of Appeal upheld a lost profits award. But there the plaintiff‘s expert based his lost profits estimate on the plaintiff‘s own profit margin and a comparison to the profits of other clinics that had participated in the preferred provider network from which the plaintiff had been excluded. (Id. at p. 227.) As far as the opinion indicates, the plaintiff and the other clinics were, in fact, comparable.
  2. Defendant vs. U.S. Government – This was a very high-profile case where Gary was retained. It was obvious that the judge had already decided the guilt of the defendant. In his three days of testimony, Mr. Capata went from the judge openly despising him and his client to listening how the government had actually entrapped the defendant and perjured themselves.
  3. Marriage Dissolution (Petitioner) – Gary had documentary evidence that the respondent (and his attorney) did not properly inquire about during deposition. Needless to say, upon testifying, the judge asked the parties to settle based on this evidence.
  4. Participated in numerous mobile home park rent control hearings. With Gary’s years of experience on the Laguna Niguel City Council and other civic duties, he was able to provide an accomplished perspective unknown to other accounting experts.
